行政任务的民营化已成为席卷全球的公共行政改革浪潮,它在提升行政效率、纾解财政压力、有效利用民间资源与技术,使国家摆脱任务负累方面表现出诸多优势。尽管相较英美,德国行政民营化的起步迟至上世纪80年代,但之后的全速推进却使德国在这一领域同样累积了丰富成果。德国经验为我们了解行政民营化提供了另一视角,让我们在取镜域外经验时有了更多元的参考;而且,因为在法教义总结方面的专长,德国经验让我们在行政民营化的规范塑造、学理整合和体系归整等法技术分析和处理方面,同样保有更多自觉。
The privatization of administrative tasks has become the tide of public administration reform sweeping the globe. It shows many advantages in improving administrative efficiency, relieving financial pressure, making effective use of private resources and technology, and ridding the country of its burden of tasks.
