改革前,检察官选任过程中存在的缺乏严格性、专业性、中立性和统一性等问题是设置遴选委员会的根本原因,配合当前员额制检察官改革是设置遴选委员会的现实需要。当前,遴选委员会在法律定位、组织结构、权力属性和职能范围等方面仍存在有待研究和亟须解决的问题。应将遴选委员会定位为不依附任何国家机关的第三方专业性机构,具有从专业角度向检察机关提出拟任命检察官人选的建议权,其职能范围应限定在具有初任性质的检察官遴选。
Before the reform, the lack of strictness, professionalism, neutrality and unity in procuring public prosecutors was the fundamental reason for the establishment of the selection committee. To cope with the reform of the current post procurator system is the realistic need to set up the selection committee. At present, the selection committee still has problems to be studied and problems to be solved in the aspects of legal orientation, organizational structure, power attributes and functions. The selection committee should be positioned as a third-party professional institution that is not attached to any state organ. It has the professional right to suggest to procuratorial organs the appointment of a public prosecutor. The scope of its functions should be limited to the selection by the prosecutor of the first grade.
