法官的判决并非是制定法的精确复写,司法裁量中有较多不确定因素,使得法官自由裁量权较大,在立法较为模糊的精神损害赔偿领域,法官裁量的差异性较大的问题尤其突出,建立司法裁量模型可一定程度上减少裁量的差异性。以医疗精神损害赔偿为例,通过实证研究明确司法裁量因素,本文建立了精神损害赔偿的BP神经网络裁量模型,个案分析和误差分析结果表明人工智能裁量模型的运行结果较为接近法官实际判决结果。进而,从模型的表现形式、建立机构和修改机构三方面,探讨如何将此司法裁量模型纳入我国司法体制。
Judge’s judgment is not an exact copy of the statutory law. Judicial discretion has more uncertainties, which makes the judge more discretionary. In the field of moral damage compensation, which is relatively vague in legislation, the discrepancy of the judge’s discretion is particularly prominent The establishment of judicial discretion model can reduce discretion of discretion to a certain extent. Taking the compensation of medical spirit as an example, this paper sets up the model of BP neural network for compensation of mental damage by making clear the factors of judicial discretion through empirical research. The results of case analysis and error analysis show that the result of artificial intelligence model is closer to the actual judgment of judge. Furthermore, this article discusses how to incorporate this model of judicial discretion into the judicial system of our country from three aspects: the manifestation of the model, the establishment of the institution and the revision of the institution.
