本文从自由心证的基本内涵出发,简单介绍了自由心证,阐明了在保证自由心证的基础上,也要对自由心证进行一些限制,即通过经验法则和逻辑规则进行保证。其次引入了“常识、常情、常理”的概念,论证了“三常”理论对于经验法则和逻辑规则的重要作用,从而推导出其对自由心证的重要价值。最后联系我国的现状,提出“三常”对我国自由心证制度建立的启示。
Based on the basic connotation of free evidence, this paper briefly introduces the free evidence, and expounds that on the basis of guaranteeing free evidence, we also make some restrictions on free proof, that is, guarantee by the rules of experience and logic. Secondly, the concept of “common sense, common sense and common sense” is introduced to demonstrate the important role of “three regular ” theories in the rules of experience and logical rules to derive the important value of the theory of “free standing”. Finally, with the current situation in our country, this paper puts forward the enlightenment of “Three Regularities” to the establishment of our country’s system of free assessment of evidence.
