GPA是政府采购国际开放协议,原则上对各国把政府采购作为宏观调控工具持否定性态度,对保护政府采购市场的歧视性购买提出诸多的限制措施。但是,GPA参加方利用狭小的法律空间,保留了一定的政府采购社会政策功能。本文将以GPA参加方的出价清单为基本素材,分析GPA参加方如何融合政府采购对外开放与政府采购社会政策功能之间关系,实现在GPA的框架下适当保留本国的政府采购社会政策功能,以期为我国加入GPA之后相关功能制度设计提供参考。
GPA is an international agreement on government procurement. In principle, GPA holds a negative attitude toward government procurement as a macro-control instrument and puts forward many restrictions on the discriminatory purchase of government procurement. However, GPA participants use narrow legal space, retaining some of the government procurement social policy functions. This article will GPA participants bid list as the basic material to analyze the GPA participants how to integrate the government procurement opening up and government procurement social policy functions between the realization of the GPA under the framework of the proper maintenance of their own government procurement social policy functions, It provides a reference for the design of related functional system after China joins GPA.
