《中华人民共和国城市房地产管理法》(以下简称“本法’)已于1995年1月1日起施行。本法虽然在很大程度上是对原有法律的整理,但仍然在内容上作了较多改变,并确立了一些新的原则,不能不引起我们的注意。本文首先从房地产开发的定义着手,接着对我国在城市房地产开发管理方面的现行法律与原有法律进行了比较分析,最后研究了本法在《物权法》背景下修改的必要性并提出了相关的修改建议。
The Law of the People’s Republic of China on Urban Real Estate Management (hereinafter referred to as the ”Law“) came into force on January 1, 1995. Although this Law is to a great extent the consolidation of the original law, Made a number of changes and established some new principles that can not but get our attention.Firstly, this article starts with the definition of real estate development, and then compares the current law of our country in the city real estate development and management with the original law Finally, it studies the necessity of the revision of this law under the background of ”Property Law" and puts forward some suggestions for the revision.
