2012年以来,检察机关全面开展对民事执行活动的监督。民事诉讼基本监督格局初步形成。民事执行检察监督的规模有所发展并取得一定成效。然而,案件数量少,监督规模难形成掣肘总体发展;获取线索不易,违法行为难发现导致监督乏力;价值定位不一;监督目标不清晰消弱监督效果;监督刚性不足,监督效果难保障有损法律权威;监督经验欠缺,业务能力提升慢阻碍工作进展。本文认为破解以上难题,必须加强顶层设计,明确职能定位,畅通监督渠道,增强监督刚性,确保监督效果,强化队伍建设,推进民事执行检察监督纵深开展,合力破解执行难题。
Since 2012, procuratorial organs have conducted overall supervision of civil execution activities. The basic supervision pattern of civil procedure has taken shape. The scale of civil execution procuratorial supervision has achieved some success and achieved some results. However, the small number of cases and the difficulty of supervising the scale of the overall development of the constraints; access to clues easy to find illegal led to lack of supervision; value orientation is not clear; supervision objectives are not clear to weaken the effectiveness of supervision; Legal authority; lack of supervision experience, slow operational capacity to hinder the progress of work. This paper believes that to solve the above problems, we must strengthen the top-level design, clear functional orientation, smooth supervision channels, enhance the rigidity of supervision, ensure supervision effect, strengthen team building and carry out procuratorial supervision in civil execution.
