公检法目标管理与绩效考核主要是计件考核。经多点调研发现,计件考核引入刑事诉讼带来很复杂的功效:它能提高控制,也带来迎合;它推动竞争,但也造成下级推难争易、姑养案源、隐瞒虚报及串通交易;它会引发上下对立,上欺下、下瞒上,也会促成上下一体;它既造成公检法冲突,又推动三者配合大于制约,违反宪法与刑诉法。其强烈激励也使得执法者忽视质量,轻视程序,加重追究倾向。调研也发现,它容纳性强,有利于新理念贯彻与组织改革成果巩固;它计量方便、监督成本低、获取信息方便、给下属更多机会与自由,有利于公检法管理与工作效能的提高。因此,一味批评不可取。计件考核出偏可通过调整考核制定程序,规范执行,理清局限条件得以纠正。
