实践中对合同继续履行判决是否具有强制执行力,如具有强制执行力但涉及多个民事请求权应如何执行等问题存在诸多争议。本文以建设用地使用权转让纠纷中的继续履行判决为例,结合大陆法系强制执行理论对实践中的争议问题进行了分析,认为合同继续履行判决可以作为强制执行的依据;如果继续履行判决涉及多个民事请求权的强制执行,要按照合同约定的顺序执行;若顺序在先的民事请求权的实现与行政机关的行政审批权力有关,执行法院应尊重行政机关的审批结果,根据具体情况可裁定“执行中止”、“恢复执行”或“执行终结”。
