民事执行检察监督指检察机关对人民法院以司法权强制义务人履行生效的裁判、公证债权文书、仲裁文书等具有强制执行内容的法律文书所确定义务的一种法律活动的监督。民事执行领域存在的执行乱、执行难、怠于执行等问题以及维护司法公正、制约审判权的需要和贯彻落实宪法、民诉法均急需民事执行检察监督。民行执行检察监督存在着法律规定不明确、监督的效力不强等问题。可以立法或司法解释的形式规定民事执行检察监督的依据、对象和方式、启动的程序等以增强民事执行检察监督的效力和可操作性。
Prosecutorial supervision of civil execution refers to the supervision by a procuratorial organ of a kind of legal activity that the people’s court enforces the obligation of legal persons, such as the judgment, notarized creditor’s rights instrument, arbitration instrument and other legal instruments with compulsory enforcement contents. The implementation of the civil execution problems, implementation difficulties, lazy implementation and other issues, as well as the need to safeguard the judicial impartiality and the power to exercise judicial power and to implement the Constitution, Civil Procedure Law are urgently required civil execution of procuratorial supervision. The implementation of procuratorial supervision by the people’s communes has the problems that the legal provisions are not clear and the effectiveness of supervision is not strong. The basis, object and mode of civil execution of procuratorial supervision, procedures for initiation and so on may be stipulated in the form of legislation or judicial interpretation to enhance the effectiveness and operability of civil execution procuratorial supervision.
