该文认为，我国现行法律将行政诉讼原告资格限于“直接利害人”是比较合适的，但如何来确定“直接利害关系人”需要确立以下规则：（1）一定种类具体行政行为的存在；（2）起诉人与被诉的具体行政行为之间有法律上的利害关系；（3）起诉人对具体的行政行为表示异议。 The article holds that it is more appropriate for the existing law of our country to limit the qualification of the plaintiff in administrative litigation to “the direct interested party”, but how to determine the “direct stakeholder” needs to establish the following rules: (1) The existence of a certain type of specific administrative act; 2) there is a legal stake in the prosecutor and the specific administrative act being sued; and (3) the prosecutor disagrees with the specific administrative act.
