《物权法》基于“物权平等保护”理念与“物权法定”原则,确立了“集体(土地)所有权”、“土地承包经营权”和“宅基地使用权”等一系列的农民土地基本权利,且确立了农民土地权益特别保护的机制,较之以往相关立法,颇有理念创新与创制整合意义;然而,《物权法》的颁布并不意味着农村土地产权制度的完美,其对农民土地权益保障仍有不尽到位的某些缺憾,如针对集体建设用地使用权流转尚无具体规制,实施机制存在某些障碍及其与相关立法的协调融合问题等,期待法律变革创新及实施机制的完善。
