第一章 总则 第一条 为支持城镇居民购买用住房公积金建造的自用普通住房,规范个人住房信贷管理,维护借贷双方的合法权益,根据《中华人民共和国商业银行法》、《中华人民共和国担保法》和《贷款通则》,制订本办法。 第二条 个人住房担保贷款(以下简称贷款)是指借款人或第三人以所购住房和其他具有所有权的财产作为抵押物或质物,或由第三人为其贷款提供保证,并承担连带责任的贷款。借款人到期不能偿还贷款本息的,贷款银行有权依法处理其抵押物或质物,或要求保证人承担连带偿还本息的责任。 第三条 本办法适用于经中国人民银行批准设立的商业银行和住房储蓄银行。
