司法语言规范化运动在司法实践中表现为对法律话语和普通话的推崇,但却因此引发了严重的沟通不畅问题。通过对中级法院和基层法院两级法院法官进行问卷调查和实地访谈获取的数据进行汇总分析发现,法官在司法活动中遇到的沟通问题,包括方言与普通话的翻译和术语与社会话语的转换两个方面。法官一律采用法律话语和普通话或者社会话语和方言,抑或对于每句话都用后者复述前者,都将抵消一部分语言的沟通效用,而原则上使用法律话语和普通话,在受众听不懂时,根据语境的差异对法官话语作转化和翻译,则可以实现沟通效用的最大化。
The judicialization of judicial language has shown itself as an esteem of legal discourse and mandarin in judicial practice, but it has led to serious problems of poor communication.
