潜规则是一种没有明文规定、不能公开明示却又在“圈内”约定俗成、为人们或自觉或被迫“遵循”的规则。它是破坏社会正常秩序、败坏社会风气的毒瘤。潜规则的社会温床是人情关系社会,它是显规则缺位或失效的产物,其本质是为了谋取不正当的利益。治理潜规则,既要加强道德自律,更要完善体制和机制,依法治理潜规则。当前,尤其要反对商业贿赂,打破行业交易中的潜规则。
The unspoken rule is a rule that is not stated in the public and can not be stated explicitly but held in the “circle” for people or consciously or forcibly “following”. It is a malignant tumor that undermines the normal order in society and corrupts social customs. The unspoken social hotbed is a human relations society. It is the product of the absence of rules or its failure. Its essence is to seek improper benefits.
