我国《保险法》第五条规定：“保险合同当事人行使权利、履行义务应当遵循诚实信用原则。”而鉴于保险合同的特殊性，法律对于保险当事人诚信程度的要求远远高于其他民事活动，当事人若有违反，对方有权解除保险合同关系。这就是所谓的最大诚信原则。
