加拿大实行联邦制,联邦中央与各省地方实行严格的分权制度,分别立法。加拿大联邦中央制定的职业安全卫生法适用对象为联邦管辖的企业,包括跨省界铁路、公路和海上运输;机场和航空公司;电信、广播、金融;以及其他隶属联邦的国有企业等,从业人员约80万。各省制定的职业安全卫生法适用对象为在省内注册、营业的企业(绝大多数是中小企业),其从业人员占加拿大1300万劳动大军的绝大多数。鉴于我国目前中小企业比例占90%以上,而且它们又是劳动安全卫生工作的薄弱环节,因此选取有代表性的安大略省职业安全卫生法(1979年制定,1990年修订)供大家参考,以兹借鉴。
