社会保障权是一项基本人权,也是保障公民生存权、平等发展权实现的重要手段,是实现公正的基本途径,但因为城乡二元的结构的制约,农民在社会中应有的权利和占有的份额未能得到公正的体现,农民社会保障权严重缺失。探讨农民平等享有社会保障权的法律和现实依据,指出我国农民社会保障权目前存在的问题,进而寻求促进和实现农民社会保障权的对策,对促进社会的发展和实现社会的公平公正具有重大的意义。
The right to social security is a basic human right and an important means to guarantee the realization of the right to life and equal development of citizens. It is the basic way to realize justice. However, due to the dual structure of urban and rural areas, farmers should have the rights and possessions in society Of the share failed to get a fair manifestation of the serious lack of social security for peasants. To explore the legal and practical basis for peasants to equally enjoy the right to social security and to point out the existing problems of peasants ’social security right in our country and to seek for the measures to promote and realize peasants’ right to social security, which is of great importance to promoting social development and realizing social fairness and justice significance.
