房屋买卖居间合同中约定委托人不得利用居间人提供的信息而私下交易的约定是有效的,非经明确说明,并无独家委托之意。居间合同中委托人有是否缔结本约的自由,应该享有任意解除权,但解除权应以支付实际损失赔偿为代价。利用居间人的居间行为而跳单,当居间行为与买卖合同定立有客观因果关系时,委托人应支付合理居间报酬。
A contract for the sale or purchase of an agreement for the sale or purchase of private property that contravenes the principal’s use of the information provided by the intermediary is not valid unless expressly stated otherwise.
