肖像权是指公民通过造型艺术或者其他方式在客观上再现自己的形象(照片、画像、录像、雕塑像及其他有载体的视感影像)所享有的专有权以及依法所具有的不可侵犯的人格权利。肖像权的主体是公民本人,法人等社会组织不具有肖像权。肖像权的客体是特定公民的肖像,包括群像中的特定人物肖像权具有以下内容:1.肖像的专有权。公民拥有自己肖像的权利,任何人负有保护他人肖像的义务,不得侮辱性地损坏他人的肖像,不得未经本人同意而取得或使用他人肖像。2.肖像的处分权。肖像的专有权决定了肖像权只能由公民本人或其法定代理人行使。这一权利是公民对其肖像权的实体处分,也就是说,公民对他人能否使用自己
