日本裁判员制度的建立是日本此次司法制度改革的核心内容之一。自2009年5月裁判员法施行以来,已初见成效。裁判员制度的设立和实施,不仅可以增强日本国民对司法活动的理解和信赖,也体现了国民在司法领域中由“客体”向“主体”的意识变革。它既是实现真正的以国民为基础的司法制度的重要环节之一,也是保障司法公正、提高司法透明度的前提。因此,日本裁判员制度的产生和实施对于我国将来改进人民陪审员制度有着积极的借鉴意义。
The establishment of Japan’s referee system is one of the core contents of Japan’s reform of the judicial system. Since the implementation of the referee law in May 2009, initial success has been achieved. The establishment and implementation of the referee system can not only enhance the understanding and trust of Japanese citizens in judicial activities, but also reflect the people’s awareness of change in the judicial field from the “object” to the “subject.” It is not only one of the important links in realizing a truly national-based justice system, but also the premise of ensuring judicial fairness and enhancing judicial transparency. Therefore, the emergence and implementation of the Japanese referee system has a positive reference for our country to improve the people’s jury system in the future.
