实现社会的善治,法治是社会治理现代化建设的重要保证,更是实现中华民族伟大“中国梦”的前提。十八届四中全会提出法治社会、法治国家、法治政府建设共同推进。然而,我国广大农村依然是法治建设的薄弱地带。本课题组以皖北地区农村法治建设为考察对象进行实地调研,基本现状是:通过“一五”到“六五”的普法和法治建设推进,广大农民法律意识逐渐提高。但是,依然存在国家对“三农”立法滞后、村民法律素质偏低、农村法治运行机制不健全不科学等诸多亟待解决的问题。针对农村法治建设现实,本文认为要通过加大“三农”方面的立法,探讨适合农村法治运行的有效机制,来助推农村法治建设。
To realize good governance in society and rule by law is an important guarantee for the modernization of social governance and a prerequisite for the realization of the great “Chinese dream” of the Chinese nation. The Fourth Plenary Session of the 18th CPC Central Committee put forward the construction of a society ruled by law, a country ruled by law, and a government ruled by law. However, the vast rural areas in our country are still the weakest area under the rule of law. The research group conducted a field investigation on the construction of the rule of law in rural areas of northern Anhui. The basic status quo is: through the popularization of law and rule by law in the “65” and “65” constitutions, the legal awareness of the majority of peasants has been gradually raised. However, there are still many problems to be solved urgently, such as the backward state legislation on agriculture, rural areas and farmers, the low legal quality of villagers and the unsound unscientific operation mechanism of rural law and order. In view of the reality of the construction of the rule of law in rural areas, this article believes that it is necessary to boost the construction of the rule of law in rural areas by enlarging the legislation on “agriculture, farmers and rural areas” and exploring effective mechanisms suitable for the operation of the rural rule of law.
