《北京公约》和《北京议定书》于2010年签订,这是民航史上第一个以中国城市命名的国际公约,必将成为国际反恐公约中的重要组成部分。《北京公约》是“制止与国际民用航空有关的非法行为”领域中相较于《蒙特利尔公约》而言更新更全面的规定;而《北京议定书》则是对《海牙公约》的修改。两份文件中明显的变化是扩大了各当事国实施管辖权的范围。对于这一问题的研究有助于深入理解两份文件的起草宗旨并为其实施提供理论上的支持。
The signing of the “Beijing Convention” and the “Beijing Protocol” in 2010 is the first international convention in the history of civil aviation named Chinese cities and will surely become an important part of the international anti-terrorism convention. The “Beijing Convention” is more comprehensive and updated than the Montreal Convention in the field of “stopping unlawful acts related to international civil aviation.” The “Beijing Protocol” is an amendment to the Hague Convention. The obvious change in both documents is the expansion of the scope of the jurisdiction of the parties involved. The research on this issue will help us understand the drafting purpose of the two documents and provide theoretical support for their implementation.
