社会、国家怎样组织起来才是有效的、安全的?这是一个历史性的课题。对这个问题的思考在社会变革时期显得更为突出。我国春秋战国时期正值奴隶制崩溃封建制确立的时期,许多思想家、政治家对这个问题进行全面深入的思考,提出了不同的主张。儒法两家是其中的代表。今天探讨儒法两家组织建设的理论与实践对我国现代化建设具有重要意义。 通过研究,笔者认为儒家的组织建设强调私人关系的建立,适于“私人领域”,是社会建设。法家强调国家权力的普遍建立,适用“公共领域”,是国家建设。所谓国家即政权组织,主要指政府及权力的范围即“公共领域”。社会即非政权的私人性质的自治系统,系统内以共同的文化要素(如血缘、地缘、业缘)为基础。本文从国家与社会关系的角度探讨儒法两家的组织建设的理论与实践。
Society, countries how to organize it is effective and safe? This is a historic issue. Reflections on this issue are even more prominent during the period of social change. During the Spring and Autumn and the Warring States Period coincided with the establishment of the feudal system of the collapse of slavery, many thinkers and statesmen made a comprehensive and in-depth thinking on this issue and put forward different proposals. Confucianism and law are two of the representatives. The theory and practice of exploring the construction of the two organizations of Confucianism and France today are of great significance to the modernization of our country. Through research, I believe that the Confucian organizational construction emphasizes the establishment of private relations, suitable for “private area” is the social construction. Legalists emphasize the universal establishment of state power, apply “the public sphere” and are a national construction. The so-called state or political organization, mainly refers to the government and the scope of power that the “public sphere.” Society is the private system of non-government autonomy, which is based on common cultural elements (such as blood, geography, and karma). This article explores the theory and practice of the two organizations of Confucianism and France from the perspective of the relationship between state and society.
