由于我国业已采取强登记主义的不动产登记制度,因此不动产继承中的登记安全问题不容忽视。根据我国具体国情和历史渊源,应尽快从立法层面正式明确继承确认程序和继承公证作为不动产继承中的登记安全保障制度。一、不动产登记安全及其重要性不动产是财产的重要种类之一,是指不能移动或者如果移动就会改变性质、损害其价值的有形财产,包括土地及其定着物等。我国不动产登记暂行条例第二条谓:“本条例所称不动产,是指土地、海域以及房屋、林木等定着物。”

According to China’s specific national conditions and historical origins, as soon as possible from the legislative level formally confirm the succession process of recognition and succession notarization as a real estate inheritance registration security system. I. Real Estate Registration Security and Its Importance Real estate is one of the important categories of property and refers to tangible property that can not be moved or if it will change its nature and impair its value, including land and its fixtures. Article 2 of the Provisional Regulations on the Registration of Real Property in Our Country says: “Real property as referred to in these Regulations refers to the fixed assets such as land, sea area, house, forest, etc.”
