辩护律师豁免权是辩护律师的一项重要的诉讼权利。赋予辩护律师豁免权,并建立相应的保障机制,对辩护律师有效履行职责,维护犯罪嫌疑人、被告人的合法权益,实现司法程序公正乃至实体公正等具有重要的现实意义。英美法系和大陆法系以及有关国际刑事司法文件中都有辩护律师豁免权的相关规定。我国应确立辩护律师豁免权。
Defense counsel immunity is an important litigation lawyer’s right. It is of great practical significance to give the defense lawyer immunity and establish the corresponding security mechanism to defend the defense lawyer effectively, to safeguard the legitimate rights and interests of the criminal suspects and defendants, to realize the justice of the judicial process and even the substantive justice. The relevant provisions of the defense lawyers’ immunities are found in Anglo-American legal systems and civil law systems as well as relevant international criminal justice documents. China should establish defense counsel immunity.
