网络转播同传统意义上的转播本质上都是向公众传播作品的行为,两者在技术方式上虽然存在一定差别,但行为的性质和效果相同,都能够使公众不用接收原广播组织的信号就实时收听收看广播节目,都会对著作权人利益造成影响。著作权制度应当将网络转播同传统意义上的转播同等对待,以维护著作权人利益,营造公平合理的法律适用环境。
