中国高等法学教育取得了斐人的成就:与美国模式、欧洲模式“三足鼎立”的中国模式形成;教学模式不断创新,尤其是引入诊所式法律教育;国际型法律人才培养机制得以开创。在总结成就的基础上,必须务实地正视当前存在的三大矛盾:规模与质量的矛盾、大众化教育与精英化需求的矛盾以及法学教育与法律职业的矛盾。为逐步化解矛盾,推进进一步创新,亟需创建三大机制:准入机制和退出机制、精英型人才培养机制以及职业型人才培养机制。
China’s higher law education has achieved phenomenal accomplishments: the formation of a Chinese model with the United States model and the European model of “tripartite confrontation”; the continuous innovation of teaching modes, especially the introduction of clinic-based legal education; and the establishment of an international legal talent cultivation mechanism. On the basis of summarizing achievements, we must face up to the three major contradictions that exist today: the contradiction between the scale and the quality, the contradiction between popular education and elitism, and the contradiction between legal education and legal profession. In order to gradually resolve the contradictions and promote further innovation, it is imperative to create three major mechanisms: access mechanisms and exit mechanisms, elite-type personnel training mechanisms, and vocational-type personnel training mechanisms.
