关于我国反歧视法的学理探究,国内法学和有关学科从反歧视法,特别是反就业歧视的体系及立法不足与完善、歧视概念的界定、现状与分类、产生的原因及反歧视的建议等诸多方面对我国反歧视进行了研究。这些研究成果丰硕,并形成了反就业歧视研究主导的局面,但在选题的范围、研究焦点、理论阐释与学科对话、反歧视策略与方法、多元性等方面还有待提高。未来的研究应不断弥补以上不足及构建中国式反歧视法尤其是反就业歧视的理论。
On China's anti-discrimination law theory to explore domestic law and related disciplines from the anti-discrimination law, especially the anti-employment discrimination system and legislative deficiencies and perfection, the definition of discrimination concept, status quo and classification, the causes and anti-discrimination recommendations Many aspects of China's anti-discrimination were studied. These studies have achieved fruitful results and formed the leading position in anti-employment discrimination research. However, there is still room for improvement in the scope of topics, research focus, theoretical explanations and interdisciplinary dialogue, anti-discrimination strategies and methods and pluralism. Future research should continue to make up for these shortcomings and to build a theory of Chinese-style anti-discrimination law, especially anti-employment discrimination.
