本文从农村宅基地与使用权的由来、国家征用流转、企业或个人流转和用益物权方面分析我国农村宅基地使用权流转的立法取向。从观念障碍、缺乏法律程序性保障和法律逻辑障碍来剖析宅基地使用权流转难点。从赋予农村宅基地以完整用益物权权能、拓展使用权流转主体范围、完善流转方式、确立期限及有偿流转使用方面,探讨了完善该项制度的对策。
This article analyzes the legislative orientation of the transfer of usufruct of rural residential land in our country from the origin of rural residential land and usufruct, the transfer of state acquisition, the circulation of enterprises and individuals and usufructuary right. From the ideological barriers, the lack of legal procedural guarantees and legal logic barriers to analyze the difficulties of circulation of the right to use homestead. From the point of giving the rural house site a complete usufructuary right, expanding the scope of the main body of circulation of the right to use, improving the mode of circulation, establishing the term and the use of paid circulation, the countermeasures of perfecting this system are discussed.
