[案情] 申诉人李某1975年在某基层单位参加工作,1992年经组织调动到某公司任副经理,2003年5月该公司部分资产被收购,组建成了某化工有限公司(被诉方)。按购买协议,新成立的公司(被诉方)接收了原单位的全体职工,并与所有职工签订了劳动合同(自2004年1月1日至2004年12月31日)。2004年5月8日被诉方在未履行法定程序情况下,做出了与全体职工解除劳动合同决定,并同意支付申诉人12个月经济补偿金。申诉人对经济补偿金月数及工资基数有异议,故具状仲裁委员会。请求依法裁决被诉方按规定支付经济补偿金及额外经济补偿金。在劳动争议仲裁期间,被诉方撤消了与申诉人解除劳动合同决定。
[Case] The complainant Lee took part in a certain grass-roots unit in 1975 and was transferred to a company as deputy manager in 1992. In May 2003, part of the company’s assets were acquired and formed into a chemical company (the defendant ). According to the purchase agreement, the newly established company (the respondent party) received all the employees of the original unit and signed the labor contract with all the employees (from January 1, 2004 to December 31, 2004). On May 8, 2004, the respondent did not fulfill its statutory procedures and made a decision of canceling the labor contract with all its staff and agreed to pay the claimant 12-month economic compensation. The claimant disagreed with the number of monthly economic compensation payments and the wage base, so shaped the arbitration commission. Request the verdict of the respondent to pay the economic compensation and additional economic compensation as required. During the labor dispute arbitration, the respondent lifted the decision of canceling the labor contract with the claimant.
