当下为适应网络交易的虚拟性、广域性、即时性等带来的挑战,各地市场监管部门都在不断创新对网络交易中存在的违法行为的监管模式,创新之中存在各种争论,其中尤为突出的一点就是对网络异地交易违法行为管辖权的确定问题。文章对目前网络交易领域和传统市场监管领域对违法行为管辖权确定的依据及其实践进行了分析,并结合事物的发展规律、行政执法高效及维持社会秩序的本质要求,认为应当对传统管辖权确定的相关理论进行创新和对相应的配套措施进行完善,使其能够解决网络交易中违法行为管辖权难以确定的难题。
