一、技术产权交易的含义和范围(一)技术产权与技术产权交易技术产权是指科技成果和相关的知识产权、科技企业产权(包括专利权转让)和以科技成果投资、风险投资等形成的产权。技术产权交易是指法人、具有民事行为能力的自然人和其他经济组织，对其拥有的科技成果、专利技术、专有技术和以科技成果投资、风险投资等形成的产权及科技企业的股权在不同地区、部门、所有制之间进行的有偿转让。技术产权交易出让方是指拥有技术产权且具有出让、合作意愿的法人、具有民事行为能力的自然人和其他经济组织。技术产权交易受让方是指需要技术产权且具有受让、合作意愿的法人、具有民事行为能力的自然人和其他经济组织。
