狱政制度是反映一部成文法司法制度是否健全的一个方面。现存的西夏法典《天盛律令》中有关囚人的法律地位、生活卫生、医疗、饮食、基本保障等都有详细的规定以及对狱禁官吏的管理等制度也明确加以规范,形成了一套完整的狱政管理法律体系,这套狱政法规就是与中国古代法律文化完备的唐、宋律令相比较也是毫不逊色。《天盛律令》不但吸收了唐、宋律令中狱政的一些传统制度,同时还结合自身实际情况有所创新,形成了一套富有特色的狱政制度。
