档案馆馆藏中存有一定数量的私人档案,且绝大多数仍处于著作权保护期内,但是档案馆对私人档案著作权问题的关注度不够。本文以分析私人档案利用的著作权问题为基础,提出应明确私人档案利用的主客体、登记机构、私人档案鉴定、私人档案开发利用程序、私人档案利用费用标准、私人档案捐赠协议等方面,力图构建馆藏私人档案利用的著作权制度。
There are a certain number of private archives in the archives’ collections, and the overwhelming majority are still within the period of copyright protection. However, archives have not paid enough attention to the issues of private archives copyright.
