诉讼文化始终对诉讼功能的实现起着不可忽视的作用。随着现代社会的发展进步,诉讼文化内涵的更新,诉讼功能不断地受到诉讼文化的影响,诉讼文化的不断充实为诉讼功能的实现起着极大的导向和牵引作用。如果没有与现代诉讼制度相适应的诉讼文化,就不能真正建构起符合现代社会发展的程序理念,进而影响了诉讼功能在现代社会中的实现。因此,深刻了解诉讼文化与诉讼功能的关系有助于我们建构起符合法制现代化进程要求的诉讼制度。
Litigation culture has always played a non-negligible role in the litigation function. With the development of modern society, the renewal of connotation of litigation culture and litigation function are constantly influenced by litigation culture. The continuous enrichment of litigation culture plays an important guiding and traction role in the realization of litigation function. Without the litigation culture that is compatible with the modern litigation system, we can not really construct a procedural idea that accords with the development of modern society, thus affecting the realization of litigation function in modern society. Therefore, a deep understanding of the relationship between litigation culture and litigation function helps us construct a litigation system that meets the requirements of the modernization of the legal system.
