发展循环经济是我国经济实现可持续发展的必由之路。我国初步建立起了循环经济法律体系,但相关法律法规衔接不一致甚至相互矛盾、缺乏严格的实施机制和责任机制等问题致使现行循环经济法律体系不适应我国循环经济发展的要求。借鉴德国和日本循环经济法律体系建设成熟经验,并结合我国循环经济发展水平和法律制度现状,确立按照“基本法——综合法——专项法”的顺序来完善循环经济法律体系,并从根本法、基本法、综合法、专项法、地方性法规等层面修订相关内容。
The development of circular economy is the only way to achieve sustainable development of our economy. China initially established a legal system of circular economy, but inconsistent or even contradictory convergence of relevant laws and regulations, the lack of strict implementation mechanism and responsibility mechanism and other issues led to the current circular economy legal system does not meet the requirements of China’s circular economy. Draw lessons from the mature experience of the construction of circular economy law system in Germany and Japan and establish the legal system of circular economy according to the order of “Basic Law - Comprehensive Law - Special Law ” according to the development level of circular economy in our country and the legal system, Basic Law, Basic Law, Comprehensive Law, Special Law, Local Laws and other aspects of the revision of the relevant content.
