教育法学是教育学与法学结合而形成的一门分支学科,在多年的发展中已经逐步确定了它的独立性。虽然教育法学现今属于教育学的范畴,但是其理论研究涉及法学研究内容,且具有重要意义。本文通过对我国教育法学研究的现状和我国教育法学既有理论体系的研究来简要分析我国教育法学理论体系并以“受教育权”为逻辑起点构建教育法学理论体系。
Education law is a branch discipline formed by the combination of education and law, and its independence has been gradually established in many years of development. Although education law now belongs to the category of pedagogy, its theoretical research involves the content of legal research and is of great significance. Based on the current situation of educational law research in our country and the existing theoretical system of educational jurisprudence in our country, this paper briefly analyzes the theoretical system of educational jurisprudence in our country and constructs the theoretical system of educational jurisprudence starting from the logical starting point of “education right”.
