四、公证人判断义务的实现 如学者已经指出的,“法律本身从传统走向现代的需要,特别是随着社会制度和社会生活的改变而需要法律相应地作出变更⑦”,而法律“变更”的前提是包括审判实践、公证实践在内的完整意义上的法律实践的发展,这必然要求公证人面向未来,在实践中灵活适用法律。尤其现代社会变化万千,中国又处在社会变迁的浪尖上,社会主体的多元化和社会关系的复杂化要求公证人通过灵活适用法律,主动积极参与社会变革,进而推动法律的进步和成长。正是基于这一背景,公证人判断义务的实现,至少应从以下三个方面入手。
