名分,于个人而言,是个体“人格”的象征;于统治者而言,是其合法性的根基;于国家社会而言,是国家繁荣昌盛和社会秩序稳定的前提;于社会体制而言,是伦理体制和律令规范的价值标准。从法哲学的角度看,“名分”理论成为中国传统法文化的一个基质。这个基质背后隐藏着三个相互勾连、相互渗透的理论:第一,天人未分之朴素自然哲学观;第二,情感本体论;第三,人格的他定。这三个理论的交互作用形成一种社会关系模态,这种模态以“名分”的表象呈现出来,最终导致个体意志、个体自由在这种社会关系模态之中消融。
