惩罚性赔偿制度起源于市场经济最先发展起来的美国。在美国的《谢尔曼法》中首次规定了对于垄断行为三倍损害赔偿的规定,其目的在于惩罚和遏制垄断行为以保证市场的充分竞争。在2008年开始实施的《反垄断法》中,并没有明确规定惩罚性赔偿制度,再加上这部法律中有关反垄断执法机构以及其权限职责方面所存在的问题,使得这部法律是否能否有效发挥预期的效用,达到最初立法的目标而受到了一定程度的疑问。因此在理论界中也出现了对于目前反垄断法中引入惩罚性赔偿制度的探讨。
