“一切有权力的人都容易滥用权力,这是一条万古不易的经验,有权力的人们使用权力一直到遇有界限的地方才休止”。“防止滥用权力的办法,就是以权力制约权力。”[1]这深刻揭示了权力之间相互监督制约的本质。因此,为了防止权力滥用,必须用其它权力予以必要地监督和制约。文章针对当前检察机关内部监督制约机制的现状,从实证的角度分析其存在的缺陷。最后借鉴同行的研究结果,从我国检察机关尤其是基层检察机关的实际出发,结合笔者自身的体会,阐述了如何在当今检察机关内部加强监督制约机制,以期能对我国检察机关内部制约机制的完善提供有益参考。
“All powerful people are easy to abuse power, which is a very difficult experience, the power of people to use the power until the place where there is no end ”. “The way to prevent abuse of power is to restrict power by power.” [1] This profoundly reveals the essence of the mutual supervision and restriction between powers. Therefore, in order to prevent the abuse of power, other powers must be used to supervise and control as necessary. In the light of the current status of the internal supervision and control mechanism of procuratorial organs, the article analyzes its defects from the perspective of positivism. At last, referring to the result of peer research, from the actual procuratorial organs in our country, especially the procuratorates at the grass-roots level, I elaborate how to strengthen the supervision and restrictive mechanism within the procuratorial organs in light of the author’s own experience in the hope of improving the internal control mechanism of the procuratorial organs in our country Provide a useful reference.
