在现实经济生活中,劳动者在从事劳动活动时,试用期的运用往往会和其他相关期限的几个概念混淆,即服务期、学徒期、实习期、见习期。同时在阐述了试用期及其相关概念的辨析之后,对其性质的认定是非常有理论研究意义的。目前,学术界关于试用期法律属性或者性质的研究较少。为此,本文试图对试用期的性质进行必要分析。
In real economic life, when workers are engaged in labor activities, the use of probationary period is often confused with several concepts of other relevant deadlines, namely, service period, apprenticeship period, internship period and probationary period. At the same time, after expounding the analysis of probationary period and its related concepts, the identification of its nature is very theoretically significant. At present, there are few academic researches on the legal nature or nature of probationary period. To this end, this article attempts to analyze the nature of probationary period necessary.
