在民亭纠纷的解决过程中，当生效法律文书进入法院的强制执行程序后，因为语言文字本身的局限、执行风险的存在以及司法权威的缺失等原因，执行释明权有其存在的必要性。执行释明权的对象主要包括执行根据、执行措施、执行风险等。这种释明权要受到正义理念、科学方法论、解释规则、法官素质等约束。
