非开放获取环境下,图书馆复制服务往往陷入两难境地:图书馆向企业用户提供复制件被出版商认定是营利性使用而被禁止。开放获取使图书馆摆脱了这一法律困境,让复制变得合理合法、有据可依。开放获取与著作权法两者并行不悖,选择开放获取并不妨碍作者依法享有著作权法赋予的权利。开放获取环境下,资助机构、科研院所、出版商都实施开放获取政策,让图书馆复制的合理性得以彰显。但图书馆在提供开放获取服务时,也需注意防止可能出现的一些问题。
In a non-open access environment, library replication services often find themselves in a dilemma: Libraries providing copies to business users are forbidden by publishers for profit-making use. Open access freed the library from this legal dilemma, making it legitimate, well-founded to copy. Both open access and copyright law go hand in hand, and choosing open access does not prevent the author from enjoying the rights conferred by copyright law according to law. In an open access environment, subsidized agencies, research institutes and publishers have implemented an open access policy to make the rationality of library reproduction evident. However, when providing open access services, libraries should also pay attention to prevent some problems that may arise.
