法院在审理劳动争议、劳务纠纷、商品房买卖、房屋拆迁、房屋搬迁、企业破产纠纷案件过程中,行政机关经常会以各种借口主持协调民事案件,确定纠纷的审判方向。这种行政机关协调民事案件的现实存在动摇了独立审判基石、违背诉讼平等原则、打破诉讼三角构架、助长了司法工具主义。其解决之道是构筑行政区划与司法管辖适度分离的司法管辖制度,并建立起“法庭之友”制度,从而将行政机关参与民事诉讼制度化、规范化。
During the hearing of labor disputes, labor disputes, sale of commercial houses, house demolition, house relocation and enterprise bankruptcy disputes, the courts often preside over and coordinate civil cases under various pretexts to determine the direction of the trial of disputes. The reality of the coordination of civil cases by such administrative organs has shaken the cornerstone of an independent trial, violated the principle of equality in litigation, broke the triangular structure of litigation and fostered judicial instrumentalism. The solution is to set up a system of jurisdiction that is modestly separated from the administrative divisions and to establish a system of “friends of the courts” so as to institutionalize and standardize the participation of administrative organs in civil litigation.
