随着市场经济的发展和社会的进步,人们的法治观念和维权意识不断提高,近年来,出现在举报领域中的法律问题越来越多,尤其是一些带有公益性目的的举报人提起行政复议和行政诉讼的案件层出不穷。由于举报人的举报,行政机关对被举报人进行了处罚决定,并向举报人书面答复了处理结果,这里出现的问题是举报人针对受理举报事项的机关所作出的答复行为能否提起行政复议和行政诉讼。这一问题的解决直接关系到举报人不服受理举报事项的机关所作出的答复的救济途径,所以笔者认为有必要对举报答复行为做以探讨。
