除各种免除人员外,香港现行陪审团条例规定有责任充任陪审员的是:“年龄在21岁至65岁之间、理智健全、非聋哑人、非盲人或患其他疾病的、品行端正、生活富足,在香港居住了一定时间,且他们既懂英语,又能听懂证人证言、律师的陈述及法官对证据、辩论等的总结者。” 1、免除充任陪审员的人员 《陪审团条例》规定的免除人员有:行政局和立法局的人员,市政局及区域市政局的公职人员,法官(包括法院系统的长官、验尸官、裁判司及太平绅士)以及其他涉及司法行政的公职人员(如警察、惩教署人员、监视缓刑犯的官员、法律方面的援助人员、法院人员、注册总署人员等)、正执业的大律师和律师及他们的书记官、香港基督教会和犹太教会的神职人员、医生(包括牙医、兽医及药剂师)、军职人员、移民入境事务处人员、海关人员、税务部门人员、消防事务处及此类机构的雇员、精神病患者。另外,驻港外交官和英联邦各种官员及他们各自的家属均特别免除。
