《国家赔偿法》基本确立了我国的国家赔偿制度,它是民主法治建设的重要成果,也是公民权利体系日益完善的标志。但是,由于其构建的国家赔偿制度还存在一些疏漏,影响了其实施效果,本文认为确立合理的规则原则,适当扩大赔偿范围,调整调整国家赔偿的计算标准及其赔偿方式,设定科学的赔偿程序,使其进一步完善,才能真正发挥国家赔偿的积极作用,真正保障人民的合法权益。
The State Compensation Law has basically established the national compensation system in our country. It is an important outcome of the construction of democracy and the rule of law and is also a symbol of the increasingly perfect civil rights system. However, due to some omission of the state compensation system it constructed, which affects its implementation effect, this paper believes that establishing reasonable rules and principles, appropriately expanding the scope of compensation, adjusting the calculation standard of national compensation and its compensation method, setting scientific compensation Procedure so that they can be further perfected so that the active role of state compensation can really be played and the legitimate rights and interests of the people can be truly protected.
