中国法律传统中的“人相食”话语已逐渐生长为中国古代法律制度和思想史上的一个观念和意义系统。以人类对“人相食”的怵惕哀矜的基本情感为起点,视其为常态化的规则、秩序与正义崩溃的表征,引发对执政者施政过程与绩效的批判检讨,强调政经文化精英乃至天下普通个体在世乱之际的责任担当,是这个话语和观念系统的主流蕴义。“人相食”的非司法化,是中国传统法文化的一个规律。“仁”被赋予规则、秩序与正义的根基的属性,这是儒家在“人相食”的话语系统的讨论中凸现的一个本土政治法律命题。
